A Line in the Sand

Two retail chains faced class action for discriminatory employment practices at every level: hiring, promotion, benefits. With many African-American and female employees, certification of the class would be devastating.

The companies acted aggressively to show that their existing policies are strong, constantly monitored, and strictly enforced. The counter-offensive worked because their story was consistent and resolute. The class action was never certified.
